‪‪2.General Conditions of Sale

‪‪This documents defines the conditions applicable for all sales from people who make a purchase via the website www.uppersocks.com hereafter called "the Client" and the Company Participazio Developpement Sarl, editor of the website, hereafter referred to as “Upper socks”.

‪‪3. Prices of Articles

All prices are in euros, excluding any further delivery prices. The validity period of the prices on Upper socks are 24 hours starting from its moment of publication. Prices in European zone include V.A.T. For order out of Europe, V.A.T. will be not charged. The products will be billed based on the current prices at the time of the order. They belong to www.uppersocks.com until the full registration of the price by Upper socks. This price is payable as a whole and only in one sum.

‪‪The Client can make an order through our website Uppersocks.com  or by telephone Monday to Friday from 9.30am to 18.30pm.

‪‪- Choose your mode of payment and validate the acceptance of the Terms & Conditions
‪‪- Validate your payment

‪‪When you are done with this process, a confirmation email will be sent to you ‪‪The Client can view and make any corrections before confirming the Order.
‪‪Uppersocks retains title of the goods until full settlement, defined as the effective collection of the payment by Uppersocks.
‪‪Uppersocks reserves the right to cancel or refuse an order if the Client disputes the Order or is a risk.
‪‪Any order implies acceptance of prices and descriptions of products available for sale.
‪‪Uppersocks is committed to fulfill any orders provided there is available stock.  If there is a lack of availability of one or more item(s) ordered(s), Uppersocks agrees to notify the Customer as soon as possible and if necessary to repay no later than 15 days  the  amounts paid after the date of purchase. In this case, the Client order will be automatically cancelled.

5. Shipping and Delivery

‪‪Any order placed on the website before 2pm from Monday to Friday (excluding public holidays) will be prepared and shipped the same day, excluding sales periods and subject to confirmation of payment.

‪‪The Client can choose 3 methods of Delivery as follows:

La Poste / Mail:

‪‪We have standard free delivery from 50€ purchase by La Poste, to your home or office. Delivery is within 10-15.

Fedex:
Delivery to your home or office, 24 hours from dispatch, Monday to Saturday.
This delivery service is charged depending on the price and the weight of the parcel.

The Customer has a period of 30 days from the date of the order to request the cancellation of the sale and refund of the products on the grounds that it would not have been delivered. No dispute delivery will be accepted after this deadline.
‪‪The Customer must check the condition of items delivered. Any anomalies regarding articles (damage, product missing compared to the purchase order, damaged package or open, defective ...) must be indicated within 3 days of delivery.

6. Payment

EU and Rest of the World:
The payment can be done by Credit Cart:
-by CB, Visa and MasterCard
-by PayPal and AMEX wih PayPal

Metropolitan France:
The customer has a choice of payments:
- by Credit Card : Visa, MasterCard, Carte Bleu issued in France
- by Bank Check
- by PayPal

If paying by check, the check must be issued by a bank in France and payable to the order of Participazio Development Sarl,  addressed to Upper socks, Customer Service, 11 rue César Franck, 75015 Paris.

Confirmation of Payment:
The payment is valid upon receipt of the check when paying by check and upon receipt of any additional information that is requested when paying by credit card.
Upper socks reserves the right to verify the personal data provided by the Customer and to adopt all measures deemed necessary to verify that the person whose bank account is debited is the one who placed the order. This is to avoid fraudulent payment.
Uppersocks also has the right for the direct cancellation of an order that would present one or more risk factors for fraudulent use of a credit card.

7. Exchange, Return or Refund

The Customer has a period of 30 calendar days from the receipt of the order date to assert his right to withdrawal or an exchange.
To do this, the Customer must make a prior request for return or exchange on the website under  "My Account", or by e-mail at support@uppersocks.com or phone + 00 33 9 72 39 87 64. Once the return request is validated by Upper socks, an email explaining the procedure will be sent back. Any eventual return that has not been subject to a prior request to Customer Service will not be taken into account.

Return or exchange is the responsibility of the Customer. Uppersocks suggests the Customer return the product by registered mail. It will be up to the Customer to retain proof of return. Return shipping costs are the responsibility of the Customer, who is free to choose the return method.
If any error is due to Uppersocks (defective item order or preparation error), Uppersocks supports the costs of returning the item. The Customer must send the invoice of the carrier to Upper socks to get compensation.

If the item is not returned by the Customer within fifteen (15) days after receipt of the return authorization mail address, return is considered canceled and the Customer must keep the product.
The returned product will be refunded or exchanged within a maximum of fifteen (15) days of its receipt by Uppersocks.  The refund does not include shipping costs or the cost of return. If the Customer has chosen a refund, the amount to be refunded will be credited to the bank account of the Customer via the payment method used when ordering: credit card, PayPal or check.
If the Customer has chosen credit, Uppersocks will send him a voucher upon return. If the Customer has chosen an exchange, Uppersocks will ship it by section in exchange (Upper socks will cover the shipping cost). The exchanges are valid only for changes in sizes of the same reference. No other type of exchange will be accepted. Any non-compliance by the Customer of these terms, including return or exchange conditions, Upper socks will not make the refund of the products concerned.

8. State of the Articles

All returned products must be in their original condition, new, unworn and unwashed. The label attached to the product, the silk thread or staple will in no case be removed. Upon receipt of the package, Upper socks will assess the state of the returned merchandise to ensure it is in sterling conditions. No returns will be accepted if returned items have been visibly damaged or used by the Customer and such use or damage makes them unfit for resale.
In the event that the returned item is refused because of proven use, items will then be returned to the Customer at their own expenses, and the Customer will not be in a position to demand compensation, or reimbursement.

9. Secure Transaction

Upper socks implements all means to ensure the confidentiality and security of data transmitted over the www.uppersocks.com website. As such, the website uses a secure payment SSL (Secure Socket Layer).

10.  Responsibilities

Upper socks is liable towards the Client throughout the contract with the Client. However, Upper socks cannot be held liable for non-performance or improper performance as in the case of force majeure, the occurrence of an act attributable to the Customer or any inconvenience, unforeseeable and unavoidable damage inherent in the use of the Internet, including interruption of service, external intrusion or presence of computer viruses.
The Upper socks website contains hyperlinks that may link to other websites. Upper socks cannot be held liable for the content of these websites should they violate the laws and regulations in force.

11. Identification

To complete an order the Client will open a "My Account" that will collect their personal data and command history or returns. This space is accessible using a login and a password. A registered Client is recognized as a Client on Upper socks.. The password held by the Client is strictly confidential and personal. It will not be disclosed or communicated to third parties.
The Client expressly authorizes Upper socks to file on the hard disk of the Client a "cookie", aimed to facilitate recognition of the Client and its identification in the "My Account" area.

12.  Protection of Personal Data

Upper socks collects data that are necessary to process a customer’s order (cf. article 12. Identification). Upper socks is responsible of this process. This information can and may be transmitted to other companies that help in the shipping of the orders.
The user is informed that the automated processing of information, including the management of users' e-mail addresses, has been declared to CNIL under the 18/11/2013 1720492V0 number. According to the law of 6 January 1978, the user has a right to access, rectify, modify and delete personal data. The user can explicitly oppose the disclosure of their details. For this, it is sufficient to report in writing to the support@uppersocks.com

13. Handling of Disputes

The responsibility of Upper socks is in any case limited to the amount of the order and cannot be held responsible for simple errors or omissions that may occur despite all precautions taken in presenting the products.
Upper socks cannot be held liable to any Member or third party for any consequential damages, or of any operating loss of profit or revenue, arising in any way, even if such damage or loss was foreseeable by Upper socks.

14. Changing of Terms & Conditions

Upper socks reserves the right to change these terms of sale and use. Members who have an account and who do not wish that contractual relations are governed by the new version of the terms of sales and use, shall notify and, starting from the date that the new version will take place, they should stop using the services of Upper socks.
In the event that any of the terms of general conditions of sale and use would be considered illegal or unenforceable by a court other provisions shall remain in force.
